Thu, Jul. 10, 2008 Johnson County judge upholds indictment of Hall
OLATHE, Kan. - A Johnson County judge upholds the indictment of the man charged with kidnapping and killing 18-year-old Kelsey Smith of Overland Park.
Defense attorneys had sought dismissal of the capital murder case against Edwin Hall because of "false and misleading" testimony from an Overland Park detective regarding another possible suspect.
District Judge Peter Riddick's ruling cited "inconsistencies" between the detective's grand jury testimony and what he heard in witness testimony. But Ruddick said he believed the indictment was justified by the evidence presented and let it stand.
Smith was last seen on video leaving a Target store on June 2, 2007, and her body was found four days later.
